Labor Authority always receive the most complain from your factory so how to explain and convince Labor Authority Officer (LAO) to believe you?
If you had read my 1st article “china-government-officer-factory-visit-1″ Labor Authority was classified as rank 2. Actually I place it as rank 3 and Custom Authority as rank 2, after some brainstorming my reason is because the risk in controlling your workers’ dispute or complain are always out of hand under company supervision, even if you use the locals to deal with the locals could only do filtering instead solving the root cause. Hence when more people involvement will create more problems to Labor Authority hence give LAO the highest authority to negotiate workers complain and put factory into justice, greatly affect productivity! Remember workers’ complains could triple jump to central government, imagine a low ranking worker in your company holds such authority, do you think everyday you are working with thousands of time bomb, is it safe? Once you understand this fact will be easier for you to accept my below tactic.
Most often complain from your workers are unpunctuality of pay date and too much overtime. LAO will only visit your factory when such complain goes into their hand or in periodically routine visit because you have bad records at Labor Authority. Is true that whenever LAO visit to your factory your middle management attitude would change towards workers, why? They would be more friendlier to the workers because always top management will question for responsibility on department head and will give penalty on their negligent. To protect their rice bowl they will give less overtime to workers indirectly creating adverse effect on more manpower turnover because less overtime means less pay, and your shipment date would also delay because no overtime how to rush production? So how to convince and settle all these disputes during LAO factory visit?
Don’t be panic when LAO visit, remember never ask any of your production personnel to involve, bad idea because they will only give more sympathy to workers and bring in side effect and creating more suspicions to your top management eventough you are right. Always let your Human Resource to filter it before goes to your juridical person (法人). Normally LAO will issue a written notice on your corrective action with dateline or will arrange another appointment for evaluation at Labor Authority or at your factory. Remember always go to Labor Authority instead allowing LAO to visit your factory again, any documents they request please fulfill it, don’t be lazy! When bringing requested documents to Labor Authority always assign to your trustworthy personnel if possible juridical person or factory person-in-charge. This is to show your sincerity to covert the major problem or penalty into a minor problem or penalty (大事化小小事化无), never challenge LAO judgment, negotiate in more reasonable and logical manner to get win-win situation. Don’t forget Labor Authority has the rights to seal your factory! Example too much overtime you could show your records on workers’ acknowledgement signature in their willingness on overtime, if lack of these records you could say new production management unaware on these policy but will correct it immediately. Don’t give stupid excuses on pushing the responsibility to your client because of tight shipment date hence incur additional overtime, Labor Law will not sympathy you!
To be frank nowadays Labor Authority are more human touch (人情味) to factory as long as you pay workers punctually, other problems are minor to them. Communist Party are now taking advantage on companies to maintain and smoothen worker employment rate and will close one eye when necessary, why? Simply because if Labor Authority seal your factory result in your bankruptcy who will pay workers’ salaries and all these lawsuits will still eventually goes to Labor Authority to filter it, do you think LAO will get themselves into troubles without any returns, got it!
